Special Damages Unit

The Special Damages Unit is made up of a team of 13 specialist staff who work to calculate the value of a clinical negligence compensation claim.

The Special Damages Unit works alongside the legal team providing advice on the information requirements of individual claims and providing detailed calculations on financial losses and expenses.

What we do

The Special Damages Unit prepares a ‘Schedule of Loss’ which contains details of all areas of loss or expense incurred as a consequence of the clinical negligence. Examples of areas for inclusion within a claim are:

Loss of Earnings:  Any absence from employment as a result of the clinical negligence can be included within the claim if evidence is available. If loss of earnings are from self employment or as a director/shareholder of a limited company, a qualified accountant is on hand to assist.

Personal Care Support: Many clinical negligence cases result in the requirement of care, sometimes in the longer term and into the future. Any care required due to the incident whether provided by an employed carer, friend or family member can be included within the claim. This includes care for a child where a parent is incapacitated.

Expenses: Any expenses incurred as a consequence of the clinical negligence, for example travelling to hospital appointments can be included within the claim

This is not by any means an exhaustive list as the quantification of a Schedule of Loss depends very much on the individual and the circumstances of the case. Advice will be provided by the legal team on an individual basis as all clinical negligence cases are different.
