Compensation For North East Family After Son Left With Cerebral Palsy

03 Mar 2010

A family from South Shields have been awarded compensation after hospital bosses admitted that mistakes were partly to blame for their son Jimmy’s cerebral palsy.

Jimmy Simpson was born at South Tyneside District Hospital and during birth he became distressed and starved of oxygen, leading to cerebral palsy. He now uses a wheelchair and needs 24-hour care.

Jimmy’s mother Kim contacted Irwin Mitchell solicitors within weeks of him being born. Now South Tyneside NHS Trust has admitted 50% liability and will make a £50,000 interim payment to the family.

Medical negligence experts at Irwin Mitchell expect this to rise to a seven-figure sum once a full investigation into Jimmy’s ongoing needs has been completed.

Angela Kirtley was the lead solicitor on Jimmy’s case. She said: “This money will allow Kim and David to get the appropriate support and facilities that Jimmy needs, while letting them concentrate on their main roles of being his parents.”
