How long have I got to make a claim?

There are time limits for pursuing compensation claims, so you should seek legal advice and start your claim as soon as possible. If court proceedings regarding your claim are not started within 3 years of you being injured, the courts are likely to say that your claim is out of time.

Although these time limits are usually strictly adhered to, there may be circumstances that mean you can still pursue your claim outside of the three-year time limit. It is always worth seeking legal advice, even if it is outside of the time limit.

You need to be aware that any claims brought under the Human Rights Act must be started within one year of the incident taking place.
