Failure to call for assistance leads to cerebral palsy
Owen Johnson’s mother, Sally Johnson was admitted into hospital having gone into labour.
Sally’s labour was slow and although she was initially monitored well, the CTG trace became abnormal indicating fetal distress. The Midwives that were caring for Sally failed to call for the assistance of a Doctor despite the worrying CTG trace.
After a significant period of delay Owen was born and it took 15 minutes for staff to resuscitate him before transferring him to a Special Care Baby Unit. Owen suffered brain damage as a consequence of the delay in his delivery and was later diagnosed with cerebral palsy.
Owen Johnson pursued a claim against the local NHS Trust, represented by clinical negligence solicitor Mandy Luckman. He was awarded £2 million by way of a lump sum plus periodical payments in the sum of £95,000 per annum throughout his adult life.
