Severe shoulder dystocia leads to Erb's Palsy

Laura-Louise was born on 25.02.03. During her birth it was noted that the head was delivered “with difficulty” and a Registrar was called for delivery of shoulders.

Several efforts were made with rotation of head to “corkscrew” out the impacted shoulders. On delivery Laura-Louise required resuscitation and it was noted that she had severe shoulder dystocia. A diagnosis of Erb’s Palsy was made.

Laura-Louise still has some restriction in her right shoulder and she finds it difficult to dress as a result. She can find it difficult to hold any cutlery with her right hand due to the difficulty with fine finger movements.

A Letter of Claim was sent to the Defendant on 05.07.07 and the Defendants provided a response on 03.03.08. In their response the Defendants made a number of admissions in respect of liability and causation. 

We obtained expert evidence from a Consultant Obstetrician and a Consultant Orthopaedic Surgeon who were both submitted supportive evidence. Expert evidence was exchanged in June 2009.

This case settled, prior to proceedings being issued, on 30 September 2009 for the sum of £100,000 in full and final settlement by way of Part 36 offer made by the Defendant.
