Failure to prevent dental decay
Sarah received compensation after her dentist failed to diagnose and treat her dental decay which resulted in great deal of corrective and reconstructive work.
Over an eleven year period, Sarah was seen for routine dental examinations and treatment. The ownership of the dental practice then changed and she was seen by a new dentist.
During the previous eleven years no concerns had been raised about the condition of Sarah’s teeth. The possibility of dental caries was never discussed and no action was taken to prevent its progression.
When Sarah's care was taken over by her new dentist a series of radiographs were taken. Sarah was advised for the first time that she had extensive dental decay. She was advised that four of her teeth required urgent remedial treatment and that a long term treatment plan would also be required.
Following a complaint by Sarah, her former dentist agreed to pay for the dental costs of the short term remedial treatment only. He did not agree to cover the dental costs of any additional treatment.
